Restricted-category DTC
CBD Marketing Agency and Digital Strategy for Cannabis and Telehealth Brands
For CBD, cannabis, GLP-1 and telehealth brands that need growth without risking ad accounts or customer trust.
Why a CBD marketing agency needs a different playbook
A CBD marketing agency needs a different playbook because the standard DTC growth loop (pixel everything, optimize to purchase, scale the winners) collides with platform policy and privacy rules, and the same is true for cannabis and telehealth. Brands in these categories face some mix of four constraints:
- Ad policy limits. Meta and Google restrict CBD, cannabis and prescription-drug advertising, and some categories require third-party certification, such as LegitScript, before ads run.
- Data limits. Ad platforms restrict the health-related data advertisers may send, and Meta has added limits on the data and events some health and wellness advertisers can use for optimization.
- Regulatory exposure. Telehealth brands may handle protected health information, and regulators including the HHS Office for Civil Rights and the FTC have addressed health data that reaches ad platforms through tracking tools.
- Channel gaps. Many cannabis businesses cannot buy paid social or search at all, and SMS carriers restrict cannabis messaging.
Platform policies change often. Operator Intelligence builds to each platform's current published policy at the time of the work, documents the assumptions and rechecks them. None of this is legal advice: every brand in these categories should have qualified counsel review its tracking, claims and creative.
Restricted-category channels at a glance
A starting point, not a ruling. Rules differ by product, state and platform and change often, so every row gets checked against current published policy and your counsel's guidance.
| Channel | CBD (hemp-derived) | Cannabis (THC) | Telehealth and GLP-1 |
|---|---|---|---|
| Meta ads | Possible within current policy, often with certification and product or targeting limits | Generally not available for THC products | Possible with certification and strict health-claim and data rules |
| Google Ads | Narrow and policy-dependent; check certification and location rules | Generally not available | Possible within healthcare policies, often with certification |
| Tracking | Server-side Conversions API with parameter controls | Analytics for owned channels; age gating | Privacy-first architecture reviewed by healthcare counsel |
| Email and SMS | Strong channel; confirm your platform's acceptable use policy | Email where permitted; SMS heavily restricted by carriers | Strong for education and retention; keep health details out without counsel sign-off |
| SEO and AI search | High value: education and product facts | Highest value: local, menu and education content | High value: education and provider credibility |
HIPAA compliant Meta pixel: what the question really means
No setting makes the Meta pixel HIPAA compliant on its own. Meta's business tools terms prohibit sending sensitive health information, and ad platforms are generally not positioned as HIPAA business associates. For a telehealth brand, the real question is architecture: what data leaves your site, through which systems, under which agreements, and whether anything reaching Meta reveals a person's health.
A privacy-conscious setup usually includes:
- A server-side layer between your site and ad platforms, on infrastructure or a vendor your counsel approves (some brands require a vendor that will sign a business associate agreement).
- An allowlist of generic event names and parameters, with conditions, treatments, intake answers, URL paths and query strings stripped.
- Consent gating and written data-minimization rules.
- Regular QA in Meta Events Manager to confirm exactly what arrives.
Whether your brand is a covered entity or business associate, and what that requires, is a question for healthcare counsel. We implement the architecture they approve.
Meta ads for CBD brands: tracking and Conversions API architecture
Meta ads for CBD brands depend on two things: an account and offer set-up that fits Meta's current policy for hemp-derived CBD, and conversion signals clean enough for Meta's delivery system to learn from. The second is where many CBD brands lose ground. Browser pixels miss events, and raw product names or URLs can carry restricted terms into the ad platform.
What we build:
- Server-side delivery through the Meta Conversions API, deduplicated against browser events with shared event IDs.
- Parameter controls so product names, URLs and content fields sent to Meta avoid restricted terms.
- Mid-funnel events, such as add-to-cart, checkout started or quiz completed, mapped deliberately so optimization has signal when lower-funnel event use is limited.
- Event match quality monitoring and a written data map.
Signal quality feeds creative performance. Our Meta Andromeda creative strategy work assumes the tracking underneath is sound.
Creative systems for GLP-1 and telehealth brands
A creative system for a telehealth or GLP-1 brand is a repeatable way to produce many ad concepts that are varied enough for Meta's delivery system and safe enough to clear review. Our approach has four parts:
- A claims library: approved claims, required disclosures and phrases to avoid, maintained with the brand's medical and legal reviewers.
- Policy-aware concept archetypes: how the service works, provider credibility, access and pricing transparency, and patient education, without before-and-after imagery, promised outcomes or copy that implies knowledge of the viewer's health.
- Agent pre-screening: drafts are checked against the claims library and current platform health policies before a human sees them, the same score-before-spend pattern as the creative analysis tool we built for &LIVY.
- Human and counsel review: nothing launches without sign-off from the people accountable for compliance.
Claims about GLP-1 medications, including compounded versions, draw particular scrutiny from regulators and platforms, which is why the claims library comes first.
What a cannabis marketing agency can do when paid channels are closed
A cannabis marketing agency has to work differently from a CBD one, because plant-touching cannabis businesses generally cannot advertise THC products on major paid social and search platforms, and state regulators, such as the Massachusetts Cannabis Control Commission, set their own advertising rules. Growth has to come from owned channels and owned assets:
- Local and organic search, with menu, location and education pages that engines can read. Our Shopify SEO and AI search method applies here.
- Email on a platform whose acceptable use policy permits your category, with age gating and consent records.
- Software and data products that give customers or operators a reason to return.
Operator Intelligence builds software in this category too: for a Massachusetts cannabis operator, we built a SaaS platform on Next.js and Supabase.

How we work as a telehealth marketing agency partner
Operator Intelligence engagements in restricted categories follow the same four-phase process as the rest of our work, with compliance checkpoints added. Most start with a two-week assessment covering tracking, data flows, ad account status and creative. A first pilot, such as a Conversions API rebuild or a claims library, typically ships in four to six weeks; larger programs run three to six months. Lifecycle email runs through agentic Klaviyo where your platform's policy permits the category. Senior strategists and your counsel review every customer-facing change before launch.
Frequently asked questions
Is this legal advice?
No. Operator Intelligence is not a law firm and does not give legal advice. We build tracking, creative and platforms to current published platform policies and to the guidance of your counsel, and we recommend counsel review before anything launches.
Can CBD brands run Meta ads?
Meta's policies permit some hemp-derived CBD advertising under specific conditions, which can include certification, product-type limits and age targeting. The details change, so we check the current published policy at the start of every engagement and before major launches.
Do you work as a GLP-1 marketing agency?
Yes, within limits. We have built a creative system for a GLP-1 telehealth brand, and we cover tracking, creative and lifecycle. Restricted-category work is a specialty track within our DTC marketing agency practice. Medical claims and disclosures stay with your clinical and legal reviewers.
What does a restricted-category engagement cost?
Cost depends on tracking complexity, the number of platforms and storefronts, creative volume, counsel review cycles and any custom builds. Request a scoped proposal and we will price your scope.
What happens when a platform changes its policy?
We recheck the affected tracking and creative against the new published policy, document what changed and adjust with your team and counsel. Restricted-category work assumes the rules will move.
